01About these terms

These terms govern your use of this website and the services offered by NAND. By using the website, you agree to them.

NAND is an informal, unregistered creative studio run jointly by its founders, SAI RAKSHAN and YUVARAJHAN, in Vellore, Tamil Nadu, India. NAND is not a registered company, LLP or registered partnership firm, and has no separate corporate personality.

Related policies: the Privacy Policy, the Security Conditions and Cybersecurity Disclaimer, the Cookie and Storage Policy and the Refund, Cancellation and Inactivity Policy. Terms agreed in writing for a specific project apply to that project.

02Using this website

You may browse this website and use the booking form for genuine enquiries. Please do not misuse the website, for example by attempting to disrupt it, accessing it without authorisation, or submitting false or harmful content.

The website’s content is general information about NAND’s services and may change without notice. The design templates and demos are illustrations with fictional businesses and content.

03Services

Available now:

  • brand showcase and business websites;
  • interactive 3D and WebGL experiences;
  • custom full-stack web applications and SaaS interfaces;
  • website redesigns and performance optimisation.

Planned for the future: e-commerce platforms and automated payment checkouts.

04Enquiries, quotations and scope

Sending an enquiry does not create a contract and does not commit you or NAND to any work. The budget and timeline you choose in the booking form are preferences, not prices or delivery dates.

Any quotation is provided separately and in writing. The scope of each project (what will be delivered, and when) is agreed in writing before work begins, and only the deliverables in the agreed scope are included. Examples on this website are a guide, not a commitment.

No payments are taken through this website.

05Student and academic projects

NAND welcomes college students, engineering candidates and academic developers.

  • What NAND does: NAND develops code, interactive 3D/WebGL interfaces and front-end implementations according to the student’s brief, and gives a technical walkthrough explaining how the delivered work is built. Only the services in the agreed scope are provided.
  • Academic integrity: the student is solely responsible for following the rules of their college, university or institution, including academic-integrity policies, honour codes, syllabus guidelines and examination rules. Please check these before requesting a service.
  • Institution requirements: technology requirements set by an institution should be shared with the enquiry. Requirements shared later may be treated as additional work.
  • No academic guarantees: NAND does not guarantee any grade, mark, faculty approval or degree outcome, and is not liable if a project does not meet a syllabus or institutional rubric.
  • No institutional endorsement: NAND is an independent studio and is not affiliated with, endorsed by or partnered with any educational institution.

06Support and maintenance

Two-month support period

Every completed website project includes two months of support at no extra charge, starting when the client formally confirms completion (or at the agreed handover).

  • Included: prompt correction of functional defects and code bugs in the agreed deliverables.
  • Not included: new pages, feature requests, major redesigns, downtime of third-party hosting, and changes or withdrawals of external services (APIs).

Optional 12-month maintenance subscription

  • Clients may subscribe to an optional 12-month maintenance plan starting on the agreed subscription date.
  • Included: regular bug fixes, minor content updates, technical assistance, and coordination of domain and hosting renewals.
  • Not included: major new features or complete visual overhauls. Third-party costs (domain registration, hosting, paid API licences) are paid directly by the client.
  • The subscription ends automatically after 12 months unless the client renews it.

07Additional work and scope changes

When you ask for additional features, new requirements, extra pages, expanded functionality, redesigns or other work outside the agreed scope:

  • NAND reviews the new requirement and estimates the additional work involved.
  • The charge is decided case by case, according to the nature, complexity, time, resources and expenses involved.
  • There is no fixed percentage, hourly rate or predetermined charge, unless one is separately agreed with you in writing.
  • NAND explains the proposed work and its estimated charge to you in writing before starting it.
  • The additional work begins only after you approve the scope and the charge in writing.

Corrections of defects covered by the support period are never treated as chargeable new requirements.

08Paused projects and resuming them

  • Resuming within one week: if a project is paused and you ask to resume it within one week of the date it was paused, no reactivation charge applies.
  • Resuming after one week: NAND may assess a reasonable, case-specific resumption charge, based on the additional work and expenses actually connected with the pause and the restart.

The assessment may consider:

  • work already completed, or work that has to be repeated;
  • reasonable effort to restart and re-plan the project;
  • infrastructure, database, hosting or other third-party expenses actually incurred;
  • other reasonable, documented costs directly connected with resuming the project.

Safeguards: there is no fixed percentage, predetermined charge or arbitrary penalty. NAND explains any proposed resumption charge and its basis to you in writing, gets your written approval before doing chargeable resumption work, and never charges twice for the same work or expense.

When a project counts as inactive and is paused is explained in the Refund Policy.

09Cancellation and refunds

If you cancel a project after paying an advance, NAND deducts reasonable, documented amounts for the work actually completed and for expenses properly connected with the project, and refunds the remaining unearned balance. Advances are not treated as automatically non-refundable. You receive a written explanation of the calculation.

The full rules, including milestones, inactivity and support fees, are in the Refund Policy.

10Domains and hosting

  • Ownership: you own and control your domain names and hosting accounts.
  • Costs: domain registration and renewal, SSL certificates and hosting charges are paid directly by you, or reimbursed to NAND if this is agreed in writing in advance.
  • Assistance, not liability: NAND helps set up deployment and coordinate renewals, but is not liable if a website goes offline because a third-party domain or hosting service was not renewed.

11Client responsibilities

To keep a project on track, clients are expected to:

  • provide accurate information, and the content and materials the project needs;
  • give feedback and approvals within the agreed timeframes;
  • make sure they have the rights to any materials they supply (text, images, logos, data).

12Intellectual property

  • NAND’s materials: NAND’s original branding, editorial layouts, custom Three.js and shader work, website copy and graphics belong to NAND.
  • Your deliverables: once 100% of the project fees have been paid and cleared, the custom code and unique design assets created specifically for you are assigned to you.
  • Third-party and open-source assets: 3D models, fonts and open-source libraries (such as Three.js) remain under their own licences (for example MIT, ISC, SIL Open Font Licence or Creative Commons). NAND does not claim ownership of third-party assets.
  • Vehicle models and trademarks: 3D car models on this website are used for artistic demonstration. A copyright or Creative Commons licence for a 3D model does not grant any right to use registered trademarks (for example the names or badges of car makers or racing teams) for commercial endorsement.

13Limitation of liability

  • To the fullest extent permitted by Indian law, this website and its interactive previews are provided “as is” and “as available”.
  • NAND is not liable for indirect, punitive or consequential losses, loss of business revenue, or data loss.
  • For paid client work, NAND’s maximum total liability is limited to the fees actually paid by the client for the specific deliverable that gave rise to the claim.
  • These limitations do not apply to liability for gross negligence, fraud or wilful misconduct, where such liability cannot lawfully be excluded.

How security incidents, cyberattacks and third-party outages are treated is explained in the Security Conditions and Cybersecurity Disclaimer.

14Governing law and disputes

These terms are governed by the laws of India. Any dispute arising from use of the website or NAND’s services is subject to the exclusive jurisdiction of the competent courts in Tamil Nadu, India.

15Changes to these terms

NAND may update these terms. The “Last updated” date above changes with each revision.
